    NetApp, Inc., 495 East Java Dr., Sunnyvale, CA 94089, is the Sponsor of this Drawing.
    Open to individuals 18 years of age or older who are legal residents of the 50 United States and the District of Columbia at the time of entry who are Tech OnTap members and who are not employees of any U.S. government and its affiliated subsidiaries. Employees, officers, directors, agents, and representatives of NetApp, Inc., its affiliates and subsidiaries, and their immediate family and household members, are not eligible to enter or win. Limit one entry per e-mail address. Multiple entries will be disqualified.
    To enter, complete the NetApp Tech OnTap Survey Drawing using the URL within the e-mail invitation, including all fields, and submit on or about midnight PST on September 1, 2010. Entrant must be the registered user of the e-mail address provided on the entry form.

    Alternatively, you may enter the Drawing by sending a 3"x5" card addressed to NetApp, Inc., NetApp Tech OnTap Survey Drawing, Attn: Mina Eng, 495 East Java Dr., Sunnyvale, CA 94089, including your name, address, and e-mail address.
    Three Winners will be determined by a random drawing held by NetApp on or about midnight PST on September 8, 2010, from among all valid entrants. Odds of winning depend on the number of eligible entries received.

    If, in the Sponsor’s opinion, there is any suspected or evidence of actual tampering or technological corruption, Sponsor reserves the right to void any suspect entries. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the e-mail account holder. Any attempt by an entrant or any other individual to deliberately damage any Web site or undermine the legitimate operation of the Drawing is a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person and to seek other remedies to the fullest extent permitted by law.
    NetApp will award one Prize in this Drawing to three Winners who will win the following prize: an Apple® iPad 16GB. An Apple iPad 16GB has an approximate retail value of $499.

    NetApp reserves the right to substitute an equivalent prize of equal retail value at its sole discretion.
    Winners will be notified by e-mail on or after September 15, 2010. If NetApp does not receive replies to its notification announcements from a Winner within one week, that Winner’s Prize may be forfeited and an alternate winner may be selected. Each Winner must complete an affidavit of eligibility and liability and, where not prohibited by law, provide a publicity release without receiving additional compensation. If NetApp does not receive the affidavit and release from each Winner within two weeks of notification, that Winner's Prize may be forfeited and an alternate winner may be selected.  A list of Winners may be viewed beginning September 29, 2010 at

    Sponsor will not be responsible for any errors in the information provided in the Drawing entries. The Sponsor will not replace any lost or stolen Prize; the Prize is offered and must be accepted “as is” without warranty of any kind; and no substitutions or cash equivalent for the Prize shall be offered.
    The Drawing is governed by these Official Rules. By participating and submitting an entry, entrants fully and unconditionally agree to these Official Rules and understand that the Drawing results are final in all respects. Winners and entrants agree that all decisions regarding the Drawing, including but not limited to the selection of the Winners, will be made by NetApp, whose decisions shall be final and binding.

    Each Winner is solely responsible for all applicable national, federal, state, and local taxes. All national, federal, state, provincial, and local laws apply.

    Winners and entrants agree that NetApp is not responsible for (i) lost, late, delayed, misdirected, stolen, unintelligible, or incomplete electronic or other mail; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties; (iii) errors in transmission; or (iv) any condition caused by events beyond NetApp’s control that may affect the Drawing. All entries become the property of NetApp.

    By entering this Drawing, each entrant and Winners agree to release and hold NetApp harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Drawing or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, misappropriation of likeness, or invasion of privacy. Winners and entrants agree that the Sponsor shall have no liability whatsoever for any deficiency or malfunctioning of any Prize, for any damage incurred from use or participation of the Prize, or from participation in this Drawing.

    NetApp reserves the right to change, alter, or amend these Official Rules or terminate the Drawing, in its sole discretion, to ensure the fair administration of the Drawing or to comply with applicable law. No cash or other substitution is permitted, except as provided herein at the Sponsor’s sole discretion. Prizes are nontransferable, unless otherwise specifically approved by Sponsor in writing.
