Permissions not cascading on files/folders created from a Mac

We have an issue with permissions cascading properly on files/folders created from a Mac (10.6.8 and 10.5.8) client on a NetApp CIFS advertised share.

All Macs are bound to our 2008 AD domain and use network accounts with local homefolders. The issue seems to happen when one or both of the following things happen:

1. A Mac user copies to/creates a folder on a Netapp share and for some reason it doesn’t inherit rights correctly.

2. We move the folder from one share on an actual Windows server to a Netapp and it doesn’t inherit permissions correctly.

Periodically our server team has to go in and force permissions to cascade. My question is what is causing this problem and is there a setting on the client or the netapp that I am missing? The files and folders in question cannot be accessed properly from Windows XP OR Mac clients.
